01 Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of the VerteX website, our products, and any live breaks or sales we operate, whether on this site, on Whatnot, or through our store ("Services"). By using the Services or purchasing a product, you agree to these Terms. If you do not agree, please do not use the Services.

02 Our products
VerteX products are professionally sealed surprise products — sealed packs whose exact contents are not shown before opening. Every item that can be pulled from a series is listed on our public, finalized checklist, and the odds and per-break guarantees for that series are published on its page before any product is sold.
- There are no hidden items and no "golden tickets." Every possible pull appears on the published checklist.
- Once a series is finalized and dated, the number of sealed products and the items within it will not change.
- Individual card values shown anywhere on the site are estimates for informational purposes only. They are not a promise of resale value, and market values change over time.
- Products are sold for their entertainment and collectible value. Outcomes within published odds are inherently variable.
03 Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or make a purchase — or have the involvement and consent of a parent or legal guardian. By using the Services you represent that you meet these requirements.
04 Purchases, live breaks, and payment
Purchases may be made through our live breaks on Whatnot, through our online store, or through other channels we designate. When you buy through a third-party platform (such as Whatnot or our store provider), that platform's terms, payment processing, and policies also apply to your purchase.
- Live breaks are conducted in accordance with the applicable platform's rules. All items are revealed on opening and correspond to items listed on the checklist.
- Prices, availability, and product details may change at any time before a sale is completed.
- Because surprise products are opened during a break, sales of opened products are generally final except as required by applicable law or the platform's policies. Our current returns and refunds approach is described at checkout or on the selling platform.
05 Product condition
Cards may be graded or raw as indicated on the checklist. Graded items are described by the grade assigned by the referenced grading company. Raw items are described using standard condition language and reflect our good-faith assessment. Photographs and mockups on the site are representative and may differ slightly from the item received.
06 Intellectual property & trademarks
The VerteX name, the PRIME Series branding, logos, artwork, and site content are owned by VerteX or its licensors and may not be copied or used without permission.
VerteX is an independent reseller and is not affiliated with, endorsed by, or sponsored by Nintendo, The Pokémon Company, Game Freak, or any other rights holder. All trademarks, character names, and card images referenced remain the property of their respective owners. Trademarks are used only to describe the collectible items contained in our products.
07 Acceptable use
You agree not to misuse the Services, including by attempting to interfere with the site, reselling access, scraping data, or using the Services to violate any law or third-party right.
08 Disclaimers
The Services and products are provided "as is" and "as available." To the fullest extent permitted by law, VerteX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any particular item, value, or outcome will result from a purchase beyond the published odds and guarantees.
09 Limitation of liability
To the fullest extent permitted by law, VerteX and its owners, officers, and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services or products. Where liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim.
10 Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted on this page, with an updated "Last updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
11 Governing law
